Ladino Wikipedia media policy

@Nemo bis: I could use some assistance, but wanted to run the discussion on my page instead of yours for (a) a little more privacy and (b) so we can handle this in a measured way and not precipitously.

I am admin and 'crat on Ladino Wikipedia, and I've been cleaning things up recently. Among other things, I went into the File: namespace to see what was there. I found about 60 picture files all told, and was able to delete about half—usually in favor of images on Commons—without losing any content whatsoever.

I need some help on handling the remainder of the files. There are now 33 files in that namespace. Of these:

• 23 are logos of one kind or another, usually taken from another Wikipedia project; under US copyright law these are probably allowable under the fair use doctrine.
• 2 are photos, again taken from other Wikipedia projects. Both original files indicate there is copyright protection, but again I suspect these may be allowable under the fair use doctrine. See item #2 in update below.
• 2 are original work that have been tagged as being released to the public domain in some way or another. These should probably be moved to Commons. See item #1 in update below.
• 1 is actually a soft redirect (at Wiki.png) to the new logo just created for our project and hosted on Commons.
• 5 others are photographs or drawings uploaded by a now-mostly-inactive sysop in 2008-9. I suspect they are his own work, but there is no particular tag to that effect on them. I may or may not be able to reach him to try to find out. All five of these files are far superior for their purposes to anything parallel available on Commons—if there is even anything parallel available on Commons. See item #3 in update below.

Of the files remaining:

• I uploaded 8, all since last August. In three cases, I was fixing red picture links that existed when I first became a sysop here. In the other five cases, I replaced files that were already on the wiki with versions that were newer and/or less copyright-intrusive.
• Three others date to 2010-2013.
• The remainder all date to 2009 or earlier.

The fact is that we don't have an Exemption Doctrine Policy formally in place, and I do not write Ladino well enough to write one. I don't know what the admins from before were thinking, but personally and informally, I'm trying to guide myself by enwiki's policy and my understanding of US copyright law. (In principle, we should probably incorporate any strictures from Israeli law on this project, too.)

Please understand: I'm not looking to expand upload rights to the community at large, and I'm not even really looking to start going out of my way to upload lots of new files myself. What I would like to do is (a) try to bring the few files we have within guidelines, and (b) be able to upload the occasional logo if and when someone should create some new content and need a logo not available in the public domain. Otherwise, we don't really want to host media files on ladwiki.

I have been writing notices to the community in English on our Village Pump, and have put through some wiki configuration changes on that basis. So I could probably get away with putting an announcement there that we would be guided by the EDP of enwiki (or enwiki and hewiki). But I would still need some help putting all this in place.

@91.9.122.22: Thank you for coming by at Ladino Wikipedia and helping us out. Let me give you an update on our progress there. I'd also like to ask you a couple of questions.
Progress.

1. Based on what you and User:CommonSupporter did, the two files that were marked as original work released to the public domain were made available on Commons, so I deleted the local copies.
2. You replaced one photograph that had been copied over from Turkish Wikipedia with one available from Commons. I deleted the local copy. (The other "photograph" in this category was a movie poster copied from Hebrew Wikipedia. I believe that file is allowable under fair use.)
3. With respect to the five files that were uploaded by a now-mostly-inactive sysop:
   • I replaced one photo that was an interior shot of an Istanbul synagogue with a file on Commons that is an exterior shot of the same synagogue. I don't really prefer the exterior shot, but I could live with it. So I substituted the exterior shot in the article, and then deleted the local file.
   • I discovered that another of the photographs was involved in a mass deletion on enwiki back in 2011 because of possible copyvios. The copyvios were not proved, I really did like that picture, and I don't think an alternative will be so readily obtained. But I decided I couldn't really justify keeping it, so I deleted the local copy.
   • The diagram turns out to be derivative of one available on Commons, just with the addition of Ladino subtitles. I don't know who actually did the subtitle work, but I am confident that at minimum that file can legally be used at ladwiki. If some of the experts on this topic believe it can be copied into Commons I would welcome that.
   • That leaves two other photos, both of Jewish facilities in Marrakech. One is an interior shot of the synagogue; substitutes are available at Commons, but I think inferior to the current shot. So I'd like to avoid deleting it. There is no substitute for the cemetary shot on Commons, and while it's very nice to quote dogma on deletion templates ("where we can reasonably expect someone to upload a freely licensed file for the same purpose"), I really don't think that a different shot of a Jewish cemetary in an Arab Muslim country is actually going to be so very readily available to us. So I'd like to hold on to this photograph, too.

Overall, then, of the seven files that have been stored locally on ladwiki and are not clearly "logos", three were deleted, one (the movie poster) I freshly assert is fair use, and another (the diagram) I freshly assert can either legitimately remain on the wiki or might even be movable to Commons. So we're down to two "questionable" files.
Questions.

1. With respect to the flag and seal of Athens, for the time being I rolled back your edit. (I didn't recognize your IP address at first, and you did not see fit to include an edit summary when you made that edit. I don't appreciate that point, in any event.) I can appreciate that a city's flag and seal could be copyright-protected, but tell me why you think that they would not be eligible for fair use on a page about that city.
2. Is there someone who can help me establish a written EDP for ladwiki?

Update of 20 December 2016

We now have 27 files in ladwiki. (A 28th entry in :lad;Special:All pages is a soft redirect to the current logo at Commons.) Of the 27:

• 23 of them are logos or public/municipal emblems, which I continue to assert can be used under fair use.
• One is a movie poster, which I continue to assert can be used under fair use.
• Two are photographs which were apparently taken by User:Maor X, an administrator on ladwiki. See his comment on my talk page there: lad:User talk:StevenJ81#Photographs you uploaded. That's not hard evidence that the photos are his. In my view, it's sufficient for me to keep them locally, though I don't know whether they can be moved to Commons on the strength of that statement.

EDP put in place. No free content—all free content must be uploaded to Commons. All files remaining (23) have documentation on non-free use rationale. I don't blame you a bit, Maor X. And if you are running a project at Wikimedia Israel to bring more editors to ladwiki (!תודה רבה) I know you don't want to see junk. I'll just point out to you and Universal Life as I have before: I can take care of many odds and ends around ladwiki, and am happy to do so. But I really cannot evaluate the quality of the Judeo-Spanish itself, and need your help for that.

The big problem is that this user has added some valuable content, and I hate to throw away the good content along with the bad. But you two are in a better position to judge that than I am:

• Possibly, we need to block the user and get rid of everything he's done. (I hope not.)
• Possibly we need to block him for a time so that we can clean up after him. (But I don't have the language skills to do that.)

Universal Life told me he was considering creating a WhatsApp group for him, you and me to use to discuss this. Why don't you ask him off-wiki about that? Somehow, we need to figure out what to do about this guy. StevenJ81 (talk) 19:43, 5 January 2017 (UTC)

Let's see how it goes, we're still in the planning stages; I still don't know who will participate. In addition to that, Hebrew speakers call the language לדינו when using Hebrew, so there's no reason to change its name in the Hebrew Wikipedia. lad:Provinsia de Los Ríos (al estar bloqueado no se puede areglar nada de mis artículos creados, eso es propiaciar la escusa perfecta y se llama trampa). lad:Chalatenango (departamento) (artículo que tuvo esa leyenda y que fue areglado ayer), lad:Orange Walk (distrito) (artículo que Steve le coloca la leyenda de problema, el cual fue arreglado y ampliado y no tiene ningún dato erróneo), lad:Meksiko, lad:Basha Kalifornia, lad:Esnoga Istorika Justo Sierra 71, lad:Patata, lad:Indiano (algunos artículos que he creado), lad:Portugal, lad:Madrid, lad:Sivdad de Meksiko, lad:Andaluziya (algunos artículos que no he creado, pero que lo he mejorado con gran pasión); lad:Tijarafe lad:Livro de Yaakov (Livro de Mormón) (artículos que no he creado y que tienen una muy baja calidad, lo cual hace pensar que es una persecusión de mis artículos para encontrar errores y buscar una bloqueo definitivo para mí.)

Todo esto es para dar razón al demandante (Akapochtli); mirén, vean, vean como yo tengo razón, ya lo dejó en paz y sigue en las mismas, sigue en lo mismo, no cambia, es de lo peor, Steve lo avala, lo avala zutano, también fulano, igual merengana, Fulano tenía razón, como no nos esquivocamos, es de lo peor, vean teniamos razón. Política de 1 euro cuando no toleran guandes cualidades en usuarios subordinados.

Si se busca una escusa de bloqueo porque escribí deskues y otras dempues, es algo absurdo, todos los que empezamos a estudiar djudeo-español y aprendimos con facilidad sabemos que dempues y deskues es correcto, si es א: o ה tampoco es un escusa de bloqueo porque es una forma arcaíca de escritura rashi, la cual es escasamente normada sin rigor, aunque si hay una lógica de sonoridad dentro de la escritura ebrea, por eso no discuto la lógica que plantea Steve, nada más que eso no es motivo de bloqueo ni de amenaza; si coloqué las tablas como un formato repetido no es porque quiera que contengan datos incorrectos, es por dar velocidad a lo que él quiere borrar porque argumenta que es muy corto el artículo y eso también es motivo de borrao, ya que ahora son dos motivos de borrado (algo mañoso aprendido de Akapochtli) y eso sea sustentado con bloqueo, lo cual ya suena a burla y una forma discreta de decirme que no quiere que siga editando ya sea por envidia porque no tolere que haya aprendido el ladino con facilidad, por coraje tal vez o porque simplemente le caigo mal.

Estoy para ayudarle en lo que necesite, todo lo que usted ha planteado y dicho ha sido tomado en cuenta, se ha corregido todo lo que usted ha pedio y se sigue corriengiedo hasta los que no son mis errores de edición. Si usted nota un error, pues también puede ayudar a corregirlos, no es algo difícil, se supone que somos marineros de un mismo barco ¿O no?, tampoco le estoy pidiendo que corrija mis datos, eso lo estoy haciendo yo, pero tampoco desprecio su ayuda si usted verdaderamente quiere ayudar. Hay muchos artículos errados en ladino que no son mios y que requieren ser mejorados (de hecho yo los estoy corrigiendo porque me siento parte de un proyecto), solo tengo la mala impresión de que usted no está a gusto que yo edite en wikipedia y no quiere que siga editando por eso observe que usted está buscando en lo más mínimo e insignificante para hacer lo que ha hecho; pero si usted me dice abiertamente, sin buscar algún pretexto de expulsión al más puro estilo de ciertos usuarios resentidos; pues dejo de editar y ya, soy bastante sabio para entender que no le simpatizo y me quiere fuera de todo proyecto, lamento mucho que yo no pueda ser de su agrado aunque he intentado ser agradable o tener una convivencia en armonía. Yo creo que es lo correcto que sea usted franco y me diga que deje de editar porque le caigo mal en vez de buscar algúna causa que le justifique, eso es de caballeros, claro que dejaría de editar porque nunca he tenido la intención de molestarle y seguiría teniedo un gran respeto hacia usted; pero eso de que si a o e, o flató una k y por eso un bloqueo, es algo absurdo y muestra sentimientos como celos o de coraje y no de razón.

Simpre ha abido una buena disposición de trabajo, se han areglados muchos errores (hasta los que no son mios) y hay artículos que se han mejorado bastante; además sigue habiendo una buena disposión para trabajar, pero lo que parece absurdo es intentar generar muchos bloqueos para darle la razón a otros usuarios como si se tratara de manchar el buen trabajo que se ha tenido, usted mismo ha visto esas mejorías aunque no quiera aceptarlo, creo que esos no son los pilares de Wikipedia ni tampoco es el espíritu que tanto se presume en cada reunión o conferencia. Mientras se ha arreglado algo con gran pasión, usted sale con otra cosa, trata de buscar otra cosa, después otra cosa y todo quiere resolverlo con bloqueos o alguna amenaza. Eso me huele muy mal, aunque yo creo que usted es muy buena persona, no me quita de la cabeza la existencia de una conspiración maquinada de sacarme de todo proyecto, por venganza, por envidia o por lo que sea.

A mis alumnos no les trato de buscar el más mínimo error para reprobarlos o mostrarles que son subordinados, eso no me haría un exelente profesor, yo estoy para asesorarlos, ayudarlos a mejorar sus planteamientos, propuestas y trabajos, a mí no me pagan para reprobarlos, humillarlos y decir que son lo peor, a mí me pagan para formar personas con altos valores educativos, personas que aprendan a investigar a proponer y resolver problemas, no para ponerles obstáculos; una falta de ortografía o un mal dato no es para reprobarlos, se les hace notar su error y se les ayuda porque la gente es inteligente y no hay duda de su inteligencia por el hecho de que tengan un error ortográfico o les haya faltado un punto; nuestra sociedad necesita talentos y gente con gran entuciasmo y dedicación para lograr grandes pasos educativos y productivos, lamento mucho que eso no pueda desarrollarse en Wikipedia, tal vez porque no nos conocemos en persona por eso el chisme o la envidia tiene mayor peso que si tomaramos un café o platicaramos frente a frente. Y si entiendo inglés pero me expreso mejor en castellano sin rodeos y sin maquillaje, ya que usted admnistra ladino, también debería aprenderlo y hacer un esfuerzo por editar en esta lengua, ansina es mejor ke uzemos al djudeoespanyol para embezar, azer muchiguamiento, troko o muda de yerros i kontar la melda sin atakos. Todo se ha realizado al pie de la letra como usted ha pedido las correcciones, jamás he dicho que eso esté mal, pero usted está usando mil argumentos para bloquear (el mismo estilo que usó Akapochtli) lo cual ya suena conspitativo porque nada tiene que ver el ruso con español, es claro que la capital de un estado o provincia es un dato corrigible el cual se estaba realizando de forma correcta, todos queremos que sea un trabajo bueno en las ediciones, lo que usted pretende corregir o es una tarea complicada ni algo difícil de hacer, basta con seguir las revisiones, usted está viendo que eso se está realizado muchas correcioes ¿Por que decir está mal el trabajo? eso no tiene ninguna lógica y eso tampoco quiere decir que usted no tiene razón o que sea mala persona. De hecho yo sigo pensando que usted es una gran persona, pero al usar argumentos de otras wikipedias o de terseras personas para bloquear ya suena muy conspitativo o simplemente que a usted no le agrada que yo edite en judeo-español. Quítese de escusas buscando el más mínimo detalle para bloquearme, si usted quiere que ya no edite porque le caigo mal o porque no le gusta mi presencia, yo ya no edito, jamás ha sido mi intensión incomodarle; si usted no tiene nada en contra mía no realice el bloqueo, ya que usted no es ese tipo de personas que busca la más mínima oportunidad para apuñalar a una persona por la espalda aprovechandose de una situción desfavorable. Yo sé que usted es un caballero y una persona honorable y no es ese tipo de calaña que se pone piel de cordero o que trabaja en grupo para hacer ataques.

Nunca he tenido intensión mala de afectar el proyecto, porque usted mismo ha visto que todo el tiempo trato de dedicar espacio para hacer arreglos y buenas ediciones, aquí solo se necesita una buena comunicación y sé que es tolerante, pero yo le aseguro que un artículo no está mal si usted tiene comunicación como la ha tenido siempre. Algo que me gusta mucho de usted, es que tiene la humildad de reconocer que no domina el ladino pero que tiene gran intensión por aprenderlo y ayudar bastante en hacer un buen proyecto, eso es ya un paso importante hacia adelante, es usted comprensible, prudente y le gusta la calidad en las cosas, así es usted, yo que más quisiera ser de agrado pero no puedo forzarle ser su amigo, no soy judío, pero conozco bastante de su religión, solo un antepasado mio profesó su fe y me la enseñó (ya que él dijo que venimos de crypto-judíos desde tiempo coloniales), además me gusta estudiar su religión y he tenido mucho acercamiento con judíos, tengo amigos judíos y me comparten su culto; yo vengo de una familia tradicionalmente católica que ha estado cerca de los ebreos. Aunque nos confesamos católicos, mi familia quiere y respeta mucho al pueblo judío desde siempre, por esta y muchas razones más no puedo ni debo hacerle enojar y acato sus regaños.--Marrovi (talk) 14:40, 2 March 2017 (UTC)

Tiene usted toda la razón, hay muchos areglos por hacer y creo que si debo centrarme a los artículos ya editados en vez de abrir nuevos artículos; eso muy bueno para el proyecto; ok, ya entendí lo del bloqueo, no tengo porque molestarme, fue un mal entendido.
