Derivative works don't have to contain the original work

It's incorrect to assume that just because a work doesn't contain an original work in whole or in part, it's not a derivative of that original. Many derivative works don't contain the original in whole or in part, such as translations to other languages, sequels to novels, etc.

On the more specific subject of "patches" or "diffs" -- "I have copyright to my edits and I can do what I want" -- I think it'd be hard to argue that MediaWiki contributors are in the business of publishing and distributing isolated, standalone patches. We edit pages in toto, and publish them as such. It's possible but not easy to get a history "diff" that doesn't include the work as a whole, or parts that existed before.

There is some limited precedent for exempting binary or source patches in software from a copyright holder's rights to control derivative works, especially when the patch fixes bugs or adds new features. However, the precedent only applies to distributing patches on their own. You still can't distribute a modified version of the original with the patch applied. That's what we do with MediaWiki -- distribute the article with the "edits" applied. I don't think the idea that "my edits" are not a derivative work holds much water. --Evan 02:23, 15 Dec 2004 (UTC)

Of course it's possible to have derivative works as you describe. It's not inherently the case that all changes someone makes to something I wrote are derivative works of my writing, though. That depends on the specifics of the situation. A paragraph covering something I didn't write about at all could be one example of something which isn't really a derivative work if used elsewhere on its own - I wouldn't even consider taking infringment action against someone who did that.

Hello. Can you tell why "freewebpage\.org" is on the block list. It would be better to block specific freewebpage\.org user names as I can't put a link to my homepage on my user page as so many do. freewebpage\.org itself is just a free web page supplier like Yahoo. Recurring vandalism on en.wiktionary.org

Hi James, I believe we have one person who already created three user accounts to come and vandalize Wiktionary with his disgusting goatse.cx image (I'm sorry I have to bring that up again. He does other stuff as well, which we can easily turn back, but these images are over the top). Is there a possibility to find out from which IP-addresses this person is coming and to block him that way? Since he creates user accounts, all we can do is to ban him, which is utterly ineffective since he can easily create another user account. I don't think there is a way for a moderator to find out what the IP address is that a logged in user is coming from, or is there? This is usually not necessary. If you do investigate it, maybe it's a good idea to check whether he is active on other Wikimedia projects as well.

Now he created user VanVoort and hello.jpg is still his favourite. Is it really not possible to block it? Or to do something about this? This also seems his work: 207.234.129.95, 216.120.134.217. How he manages to have so many IP-addresses is beyond me, but the style is mostly the same. Maybe he controls some machine on the internet that are infected with Trojan horses. I guess we can't do anything about it in that case. It is getting more than annoying though. We can try to delete and revert everything he does. You could say that's our job as sysops, but this hello.jpg is over the top. Is it really not possible to do something about that? Polyglot 13:04, 29 Jan 2005 (UTC)

Spam filter malfunctioning

The spam filter's on the blink again. Please see pornography addiction. Try to fix one of the links, and see what happens.. I had to change them all from http:// to ttp:// to get it to save, so they are disabled at the moment.69.243.41.28 02:33, 29 Jan 2005 (UTC)

This is caused by the blacklist on any URL containing "porn.com", which matches the "no-porn.com" URL you were trying to save. Would it cause a problem to comment this one out? Silsor 03:52, Jan 29, 2005 (UTC)

Comments on Meta nofollow

Hi James. I have added some comments on nofollow at meta which I thought I would draw your attention to. Google has offered the possibility for years for nofollow links through the syntax http://www.google.com/url?sa=D&q=http%3A%2F%2Fwww.example.com so there was in my view no urgency for a sudden straw poll amongst developers on the issue. Also my vote count is that about 80% of the people on the straw poll think it should be reverted at least for en. I have also reverted many thousands of pieces of spam on different Wikis but I think both that you are wrong (that's discussed at nofollow) and that this wasn't a correct piece of behaviour by the developers --BozMo 09:58, 2 Feb 2005 (UTC)

Downtime notices on the foundation wiki

Hello, JamesDay, would you like to help us for making the recent downtime reports on the Foundation Wiki? I talked with Anthere (you remember this talk supposingly) and later with Jimbo, and we came to the conclusion we will provide information to visitors on the Foundation Wiki.

The site provides information to visitors in two places: Home page and "Current events". Would you give glances to Home draft and Current events draft? Thank you very much for your recent work on Transwiki. I'm only slowly coming to grips with the amount of page history that's being deleted from the English Wikipedia as images are moved to Commons (and presumably in many other situations). Ah, how embarrassing. I've forgotten my wikipedia password. Unfortunately, the "e-mail new password" thingy doesn't seem to work. (I don't remember if I ever entered my email address in ... or perhaps I did but mis-typed it). I suppose I could just make up a new user account ... but that seems so wasteful.

Angela helpfully suggested "someone with at least shell access from the list of developers". I got your name from that list of developers.

Is http://david.carybros.com/ enough evidence that I really am David Cary, and the appropriate email address to use?

p.s.: I was using the same password for Wikibooks:User:DavidCary. Would you reset that one as well?
