[edit]yeah, you would think that the US would adopt freedom of panaroma like the Germans, but no such luck. the copyright of sculpture was upheld in GAYLORD v. UNITED STATES [1], see also en:Korean_War_Veterans_Memorial#United_States_postage_stamp_court_case --Slowking4 (talk) 22:54, 6 November 2021 (UTC)
- @Slowking4: thanks for the references. Bizarre how jurisdictions can differ so substantially on basic issues like this. AleatoryPonderings (talk) 00:38, 7 November 2021 (UTC)
- yes, the international comparisons boggle the mind. the US judges like to limit copyright based on a theory of "creative content" - they think a mechanical copy of 2D is not "creative enough", even though good images of painting are a lot of work. but the lighting / angle of view chosen by photographer of a sculpture has some creativity. the swedish court have limited "freedom of panorama" based on other factors such as "database right" [2] case law is scarce, since you need recalcitrant litigants to test the status quo. --Slowking4 (talk) 22:34, 7 November 2021 (UTC)
