Photo Contest Quick License

In order to use the Wikimedia marks for a photo contest, please fill out the license below and email it to trademarks@wikimedia.org. Make sure to check whether you actually need a license as some uses are allowed without permission. The Wikimedia Foundation, Inc., (“WMF”) grants _____________________ (“you”) a non-exclusive, non-sublicenseable, non-assignable limited license to use the "puzzle globe" mark, "The 'W' icon", the “unified mark”, the "Wikipedia wordmark", and the “Wikimedia Commons logo” for a photo contest.

How can I use the mark?

Approved Use: The marks may be used on promotional material, such as flyers, posters, slide presentations, social media & email invitations, and the contest website with respect to the photo contest. The use must comply with the Visual Identity Guidelines, and the rules on proper use under Section 2 of WMF’s Trademark Policy. The use must also be consistent with the Wikimedia mission and the projects for which the marks are intended to represent.

Our community creates free, high quality educational content in an open and collaborative way. Use of our marks must reflect these qualities. In addition, you must ensure that any materials carrying the mark are well maintained while they are publicly displayed.

What do I need to give to WMF?

Quality Control: You will provide samples of your intended use of WMF marks on any flyers, posters, slide presentations, screenshots of digital correspondence, or mock-ups when you email this license to WMF. You agree to promptly respond to WMF’s requests for additional information or to an inspection of your use.

What can’t I do?

Affiliation: Your use of the marks may not suggest that the event is in any way affiliated or endorsed by WMF.

How long will this license last?

Termination: This license will automatically terminate after the photo contest. WMF may terminate this license at any time by providing notice to you in any manner if it determines that the use is inconsistent with our mission or could expose community members, or movement organizations to liability.

All provisions shall survive the termination of this license except for the approved use and quality control provisions.

What else should I be aware of?

Disclaimers: WMF disclaims any responsibility for the content contained in the Wikimedia sites, including but not limited to content created and posted on the Wikimedia sites by third parties, including users of the sites.

All WMF marks are provided “as is.” WMF disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement, and any other express or implied warranties with respect to WMF marks and content. WMF will not be liable for lost profits and loss or damage to data arising out of the use of any WMF marks, or any other indirect, special, incidental, or consequential damages. WMF’s aggregate liability arising out of this license will not exceed USD $100.

Whose law governs?

Choice of Law: The law of the state of California, without reference to conflicts of law, governs all adversarial proceedings arising out of this license.

What other terms are there?

Severability & No Waiver or Assignment: If any provision of this license is unenforceable, that provision will be interpreted to accomplish the objectives of that provision to the greatest extent possible and the remaining provisions will continue in full force and effect. Failure to enforce any provision will not constitute a waiver. Neither party may assign or transfer any of its rights or obligations under this license without the prior written consent of the other party.
