I'd add that this issue is seen very differently in other parts of the world. In Germany, for instance, individuals with limited legal capacity (7-18) may license a work, but that contract is only valid if agreed to by her parents / legal guardians, precisely because the act of licensing is always legally disadvantageous. That has a direct effect also on Wikimedia projects if copyright is enforced in a German court of law. —Pill (talk) 21:26, 14 June 2012 (UTC)

It is definitely true that the law of minors varies by jurisdiction, even among the different U.S. states. Since the Terms of Use set the legal forum in California, this is based on U.S. Copyright and California family law. Hahnw (talk) 17:51, 15 June 2012 (UTC)

I understand, but as the terms of use rightly point out, courts around the world might not wish to comply with that ... at least in Germany, a court wouldn't care about WMF's choice of jurisdiction when it comes to, say, a German user including picture by a German 13-year old in a dewiki article, so it's a question that does arise for volunteers, as well.
