It should perhaps be noted, in our response, that any and all "neighbouring rights" established in the past have completely failed. The worst failure, acknowledged by nearly everyone, is the sui generis database rights; then there's the quasi-copyright on cultural heritage in Italy and elsewhere; and of course the closure of Google News in Spain. We should also analyse the use of scans of PD material in recent publications. For example: Books of reprinted old postcards. It is allowed in the Commons, while many publishers disagree. Also taking pictures of old paintings in museums could be problematic if neighbouring rights are expanded/enforced. I avoid scanning PD works from books and much prefer to have an original postcard in my possession. I never use recent publications wich are still on sale. I also only scan a few to avoid database rigths. It is unclear how far the EU proposals affect these kind of uses.Smiley.toerist (talk) 11:53, 13 April 2016 (UTC)Reply
