Consequences of the German Federal Court’s judgement of 2nd March 2010 regarding the "competences of German courts for action against Internet publication of the New York Times”
Resolution: The Generally assembly entrusts the board to draw up a report on the consequences of the German Federal Court’s Judgement of 2nd March 2010 until 31st August 2010.
Reasons: According to the German Federal Court’s Judgement of 2nd March 2010 German courts will be responsible for all jurisdictions concerning the “interference with personal rights on the Internet through a searchable article if the article has clear links to Germany”. (According to § 32 ZPO)
A German resident has taken legal action against the publisher of the daily newspaper The New York Times and the New York-based author because of interfering with personality rights. This article is stored in the Online Archive.
It is therefore necessary to discuss the legal consequences in case of claims against Wikipedia in the future.
